With the growing number of corporate failures now at a record high, it is critical that practitioners understand the tax, legal and practical implications of insolvency.
Session Overviews
Session 1 - Income tax and GST issues
This session will focus on:
The income tax issues for companies as they approach insolvency and for external administrators managing an insolvent entity, and the counterparts with whom such companies contract
The process by which the Commissioner seeks to recover outstanding tax amounts and the remedies available to taxpayers to challenge that recovery
The GST provisions dealing with insolvent entities, including a discussion on the further amendments that are expected to clarify the operation of some contentious provisions.
Session 2 - Liability of directors and investors
This session will provide practical guidance as to what insolvency really means and how directors can manage their liabilities and properly discharge their obligations. It will also cover some aspects of the Commissioner's power in the debt recovery process.
