The PPSA will commence on 30 January 2012 when the Personal Property Securities Register (PPS Register) goes ‘live’.  The provisions of the PPSA are revolutionary in terms and will significantly alter legal title over personal property.  Every area of business will be affected.  In particular suppliers, sellers and distributors of goods by way of sale or consignment need to take immediate action.  Similarly hirers/lessors of plant and equipment and motor vehicles are immediately affected.

Session 1:  Introduction to the Personal Property Securities Act 2009 – Critical overview and key concepts

This introductory session will provide an overview of the PPSA and its key concepts, including:

  • What is personal property?
  • The PPS Register
  • Who needs to register?
  • What is a ‘security interest’?
  • What is a purchase money security interest (PMSI)?
  • Registration information and how to register
  • Effect of registration or non-registration
  • Transitional security interests
  • What is ‘attachment’, ‘perfection’ and ‘control’?
  • Amending or removing registration – ‘discharges’
  • Priorities
  • Timeframes for ‘perfection’
  • Enforcement.
